    This is a bit of a convoluted question, so I'll start at the beginning. In 2005 my husband(UK citizen, I'm a US citizen) was arrested for domestic violence. At that time, he had been overstaying his visa waiver for about 9 months, as we had been meaning to file his request for permanent residency, but had been lazy and put it off. Anyway, since he overstayed, USCIS took him to a detention center, where he stayed for about a month, and one day they just told him he was going home, they bought him a plane ticket, and sent him on his way. He never received any papers of any kind, all that happened was that his A-number was written in his passport. One of the agents told him he'd have a 3 year ban, another told him it would be 10 years. So, anyway, it's 4 1/2 years later, and we've started trying to find out when he could possibly re-enter, just to visit(we both live in the UK now, but still have family in the States). From what we read, we realized that maybe he wasn't actually technically deported. We called EIOR and found out that his A-number isn't in their system, so obviously he wasn't actually deported. The woman there said it sounds more like an expedited removal. We tried asking ICE what the length of his ban is, and they said we'd have to file a FOIA to find that out. So, until we do that, we're going with the working theory that it's a 5 year ban, since that seems to be what you get for expedited removals. Anyway, if it does turn out to be a 5 year ban, he'd be able to return in a few months, which would be awesome, but we're wondering what the chances of getting approved for a B-2 are. Also, assuming they let him visit, what are the chances of him ever getting a spouse visa, so we could one day move back to the US? Thanks!

    Unless you know the outcome, you never know.

    Just be candid and talk to your employer. Sometimes they don't even know this as diff ppl in HR handle and interpret cases differently. I would talk to my employer.

    My mother came for a 6 months visit on December 10th of 2010. But she left in April of 2011 (April 9th 2011), two months short of her 6 month's stay. Can she come again in August 2011 for a six month's stay, and stay till Feb 2012? Or will she have to return in 2 months? (return by October 2011)
    My mother has 10 year multiple entry visa.
    I heard that a visitor can stay only 6 months in a year, is it true?
    If yes, is the calendar year counted from January to december?

    Hi All,
    I recently noticed the Audited Dates for PERM moved up nearly by 9 months to Dec 2009.
    My labor filed in June 2009 has been in audit.
    My employer is telling that that still my case is in process.
    Has any body filed in 2009 and been in Audit got it approved recently?

    Those of you who have audited PERMS should check with the employers as the employers may not be checking the status regularly. Please do post if you have any updates.

    what makes you think that i am an anti-immigrant, and do you think that i am giving publicity. this is from an ad that i came across that says that 1.5 million immigrants are being brought into the country to work annually. i wanted to bring this to the attention of the forum so that we can do something to stop this false information propagation. otherwise, think about the hatred the american public will have when the time comes for CIR to be implemented. for every call we make, there will be 10 calls to oppose. unless we stand up and fight the misinformation, we are not going to see any progress. and maybe it is easy for you to label anyone as an anti-immigrant being an EB2. I lost out on my 2001 PD due to the mistake of my lawyer and am now saddled with a 2004 PD. Easy for you to talk, when you dont know the issues that those of us who are languishing for more than 10 years here are going through.

While there is some satisfaction in the fact that the House did not get the higher L fees that it sought, this is cold comfort. Truth be told, it was a tough week, the worst in a long time, and the shock among pro-immigration circles, both on Capitol Hill and beyond, is palpable.
    Removal of Section 8001 from the Budget Reconciliation Conference Report can be a temporary setback if we play our cards right. Congressman Sensenbrenner has long and loudly proclaimed that he is not against all immigration, just the illegal variety. Fine. Let�s take him at his word. He is, after all, the architect of the new E-3 visa that enables 10,500 Australians to get around the H-1B cap. Congressman Sensenbrenner has his enforcement-only bill now so he should be prepared to support us when we seek to attach Section 8001 to broadly bipartisan legislation in the upcoming session of Congress. If Congressman Sensenbrenner means what he says, and he usually does, this might be a golden opportunity to bring Section 8001 back to life.

    Thanks Elaine for your reply. Yes you are right, it is a substituted labor, but I have raised the concern because my PD is May 2005 which is after PERM came in effect. Hence how did the lawyer use the old (pre PERM) EAT 750B for this labor ?

    I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. NOW IF I GET FULL TIME JOB WITH OTHER EMPLOYER (other field)AND IF I WORK LESS HOURS (means I get under pay than showed in labor) WITH SPONSORING EMPLOYER, WILL I BE IN TROUBLE?     I am unable to determine if the 180 day timeline is calculated from RD or ND? There are different opinions here in this forum and no clear answer. Is there a law text that defines this clearly...does anybody know?

    If the Form I-140 has been approved and the Form I-485 has been filed and remained unadjudicated for 180 days or more (as measured from the Form I-485 receipt date), the approved Form I-140 will remain valid even if the alien changes jobs or employers as long as the new offer of employment is in the same or similar occupation. If the Form I-485 has been pending for less than 180 days, then the approved Form I-140 shall not remain valid with respect to a new offer of employment.

    hi,
    i am planning to file eb2 and port my eb3-i140 pd. My current position is system analyst with eb3 job requirement. I can get a promotion but that doesnt qualify for eb2 job requirement. So i am planning to move to a different position, research associate which qualifies for eb2(it requires masters degree) with the same employer. Can i file eb2 with this position and port my eb3-i140 pd? Advice pls.
