You would need to take an updated affidavit of support and you latest tax returns if you have filed for any dependents and they have been called for the interview also. Would be useful for you to take the I-140 approval with you. All your original certificates, including birth and marriage, employment letter, W-2's, medicals if the ones that you submitted have expired, you need to follow the list of documents as per the interview letter. If your spouse has been called for the interview you would need to take joint documents and photographs to show that it is a bona fide marriage.

My employer filed the PERM with EB-2 in September 2007. It was audited in November. Still waiting. I have the fear I could get laid off. If this will happen before the Labor Department approval, and before the 1-year renezaw of my H1-B (exp. Sept.08), what will happen? Do I loose everything?

We are going to demand TRANSPARENCY in addition to efficiency for BECs. Its a part of Immigration voice's agenda.
Is there ANY mechanism right now for applicants or their attorneys to find out what's going on with their PERM application? Is there a phone number you can call or an email address you can write to? It seems that at a minimum the processing centers should issue a monthly report on the progress and issues encountered.

Is it possible to have second H1b visa and Labor certificate approved for employer "B" while working on H1b visa and having Labor and I 140 approved for employer "A" ??

Yes, that is possible. However, you don't need to have a second H1B with employer "B" in order for that employer to apply for LC and 140 for you since LC and 140 are for future jobs.

It is not an issue for people of Indian origin who are returning, of planning to return, back to India for whatever reason. They are the lucky (?) ones to have either a Indian passport or PIO card or OCI card so they are eligible to work on that basis.
But how about those who do not qualify for one of the above? There is an increasing number of foreigners working in India - how do they become eligible to work in India? Is there an equivalent of an H1B, or may be oneday GC & Citizenship?

can someone pls help me with a few question on re entry permit. i will be going back to us after 1year 8months. i had applied for re entry perit in oct 2007 - i left us in may 2008 - my re entry permit is valid till july 2010. i will be going to us in feb 2010. my question is will i have problem because i left us before i got my permit. my husband who was still in us got my permit for me.
As far as my understanding goes, as long as you applied for the permit while in US, you are good. It should not matter if you got your approval after you left the country.
Please do check with others as well.

You actually were out of status since Dec 30 till this moment and you still are out of status. You are immediately out of status once you are not paid for the job or fired, regardless of the fact if employer revokes H-1 or not.
You can not do H-1 transfer any more. Your next H-1 petition will be a new petition but you will not be subject to H-1 cap as you already have been counted for 6 years.
So I presume it would safe to get a job offer and leave as soon as possible, then wait for the H-1 petition get approved, stamp H-1 visa and get back.

The United States Immigration and Customs Enforcement (ICE) recently updated their list of Student and Exchange Visitor Program (SEVP) approved schools (http://www.ice.gov/doclib/sevis/pdf/ApprovedSchools.pdf) .
The schools listed have all been certified to participate in the program. The program allows foreign students interested in obtaining an education in the United States to complete a visa petition, pay the required fee, and attend a U.S. College or University. The Department of Homeland Security (DHS) created a web based system called the Student Exchange Visitor System (SEVIS) which maintains information on the foreign students accepted into the program. The SEVIS monitors the students for the duration of their approved stay, as required by the Illegal Immigration Reform and Immigrant Responsibility Act (IIRAIRA) of 1996.
Interested Foreign students: There is a process in obtaining a student visa, but it is not a difficult one. At the interview, the student must have Form I-20, proof of payment of Form I-901, financial support documentation, and a completed visa application. Can you please help me figure out how to calculate the eligibility for citizenship. If one married a US citizen. Obtained conditional residency, the temporary green card, then forgot to apply to remove conditions. So re-applied for green card, and was granted. The parties have been married 5 years. Will the initial 2 years spent as a conditional resident count towards the 3 years for the citizenship? Again, I want to stress out that after the initial 2 years in conditional permanent residency, forgot to remove conditions, and a new application for green card was needed. However this time the permanent green card was given. Or will she have to wait another 3 years from now on with the permanent green card until applying for the citizenship?

MY PD - July 8 2004, RD July 2 2007 NSC. I-485 - Pending USCIS's mistaken with EB Classification. (came to know of this after opening 3 SR's and 3 Infopass appointments).
My Attorney wrote to USCIS last week about the problem with my I-485 (USCIS mistakenly put me as EB3 instead of EB2). I want to know experience of memebers / Attorneys who have writen to USCIS for any reason(s) (USCIS Mistakes, Eb3->EB2 porting, Etc) and goten response and how long did it take for getting the reponse. Any Hard LUDs/Soft LUD's after sending letter etc.
Please share you experience.
