OK...I just got an email from my Attorney. It is indeed what she thought. She received our receipts today from the CSC. The receipts have a receipt date of July 23rd and a notice date of September 19th. As to why the CSC sent out the other notice transferring the case back to NSC to me only and not the Attorney...that is a mystery. She plans to speak to our State Senator and hopefully get some answers.

Hello Guys,
First and foremost my sympathies on being a part of MI where almost everything is going the wrong way work situation, housing market and weather its been raining for almost 2 days now :), for fellow members there is another hassle of worrying about your immigration status.
Things are bleak no doubt about that but we can make a difference no I am not trying to act or sound like The President of United States here, just trying to make a point. Hey given the present situation we can either lie down and take what the government has in store for us (which is erratic movements of PD�s through the visa bulletin which are most probably by the shots taken by the DOL just before the release of the visa bulletin) or take up the fight and try to make our voice heard.
Hence to restart the chapter I would like to see if any of you are interested in a face to face meet to exchange stories and to brainstorm ideas to tackle the situation that we face currently.
Ideas and suggestions welcome, lets make the change that we were promised last year.

Did ur parents mention in their DS-156 as self-financing or did they mention ur name ?
My parents applied for visa ..
documents submitted
1) Bank deposit in US around 9000 $
2) deposit in india about 10000$
3) Job No objection certificate ( parents )
4) affidavit's of support
5) They carried all property documents in india ( valuated by CPA )
6) my H1b1 copy and a letter of invitation from me

Yes , I did extension for H4 to avoid out of status. But that will automatically override her approved H1 to h4.(The latest one is valid). But when ever she is ready to work, (in her case she is pregnant and planning to work from next year only) her employer has to change the H4 to h1b(COS). There is premium processing and it would take only 15 days. No need to apply for a fresh H1b.

Anyone of you who has been fingerprinted and had interview with USCIS,
How long did you take to be given a schedued appointment for interview after the fingerprint? Did you have an interview right after the fingerprint?
Is that possible to have it both on the same day?
I am asking you because I would like to travel outside of the country with AP as soon as I have my fingerprint done.
If I would be nortified of the interview date right after the figerprint, I would rather stay to finish everything before travel. That way, I won't cause any troubles, right?

Are there people who are current now, who have no Priority Date mentioned on the I-485, EAD and AP receipts? (i.e. the PD box is blank)
The priority date is shown on my I-140 receipt, but not on the aforementioned documents.

Hi guys,
I hit a road block lately with my new H1B application. I'm on extended OPT and filed for my H1B in regular processing in the month of Sep'10 while working for a Client A. The Client A could not provide an Client letter during that time. My employer has then proceeded with a letter from my Prime Vendor . Then, unfortunately after 1 month of filing my H1B, my contract with Client A ended and I moved to another contract with Client B. Now, USCIS had few questions with Client A because of missing client letter and gave a RFE on my case. My employer then responded with an amendment petition to the RFE with the new Client B and also provided a client letter from Client B this time around. But, unfortunately USCIS has rejected the amendment petition and stated they are looking for Client A stuff as the primary H1B application has listed Client A and now, I just received an update that my H1B has been denied stating the same reason that USCIS is still looking for response to the query on primary client (Client A). I'm really struck now as my employer is in no mans land whether to file for a MTR or not, fearing that USCIS might not change the verdict because they might still look for Client A letter.

I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks
Lawyer is right. If you leave the country, you will be barred for 10 years from re-entry if you accumulated more than 1 year of "unlawful presence" ("out of status" is different and it is not a such a big deal to lose status as long as you do not accumulate unlawful presence). If you stay, you may be able to eventually get green card.
Can you provide more details regarding your timeline? Was I-485 filed? If you had pending I-485, "unlawful presence" counts from the date I-485 has been denied, not from the date H1 has expired.

Can you walk in for un-scheduled apointment? ... Now days this might not be permissible, but I remember 5 yrs ago at Toronto consulate, after all scheduled applicants have been lines up timewise, un-scheduled applicants were asked to form line behind on first come first basis. Not sure if anyone got chance, as I was like most lined up ahead in scheduled lineup. But wonder if it is still permitted, how about taking chance?

This is a bit of a convoluted question, so I'll start at the beginning. In 2005 my husband(UK citizen, I'm a US citizen) was arrested for domestic violence. At that time, he had been overstaying his visa waiver for about 9 months, as we had been meaning to file his request for permanent residency, but had been lazy and put it off. Anyway, since he overstayed, USCIS took him to a detention center, where he stayed for about a month, and one day they just told him he was going home, they bought him a plane ticket, and sent him on his way. He never received any papers of any kind, all that happened was that his A-number was written in his passport. One of the agents told him he'd have a 3 year ban, another told him it would be 10 years. So, anyway, it's 4 1/2 years later, and we've started trying to find out when he could possibly re-enter, just to visit(we both live in the UK now, but still have family in the States). From what we read, we realized that maybe he wasn't actually technically deported. We called EIOR and found out that his A-number isn't in their system, so obviously he wasn't actually deported. The woman there said it sounds more like an expedited removal. We tried asking ICE what the length of his ban is, and they said we'd have to file a FOIA to find that out. So, until we do that, we're going with the working theory that it's a 5 year ban, since that seems to be what you get for expedited removals. Anyway, if it does turn out to be a 5 year ban, he'd be able to return in a few months, which would be awesome, but we're wondering what the chances of getting approved for a B-2 are. Also, assuming they let him visit, what are the chances of him ever getting a spouse visa, so we could one day move back to the US? Thanks!

I have spent over 3 years in US. Can I file for H1B extension based on 6 years window for H1B visa. My situation is I am in India and the company is filing this fro me in US.
What are the chances of getting this extension approved?
1. I have maintained a legal status for 3 years during my stay in US.
2. 221g was the problem I couldnt get back to States.
3. 221g got cleared but my I 797 got expired and old company withdrew H1B extension.
4. Now one company is helping me with H1B extension based on my case as detailed above.
Pls advice about the possibility of getting this H1B extension. I am kind of waiting on this for long.

I am applying for MBA program in american sentinel university.
I want to know if I am eligible to apply for H1B in master's quota after I graduate from this univ. American sentinel university has Institutional Accreditation by the Distance Education and Training Council (DETC). Please help me in this regards.
Today I called USCIS and they said that they cannot tell anything and only service centers take decision on the case.

I am having an option of joining a new employer with whom to file LC. Company is not very big 50 employees and started in 2002.
I am very worried about the stability of the company. This kind of companies are normal or I am just unneccessarily imagining and worrying ???
How to check the stability of a company before you start filing anything ???
Anybody knows about this ??
absolutely no idea based on the info you have provided, but you need to consider a lot of things here.
1. If its a startup building the same product 5 years later, and does not seem to be expanding/growing, its probably not going to be around much longer. If its a consulting/contracting firm that works with bigger fish, it will probably be around in the future.
2. You need to also analyze your appetite or risk. If you are on 5th or 6th year of H1, then it could be risky. If its year 1/2/3/4 and you like everything else about this company, go ahead. Worst case they close in one year, you will have LC+I140 approved and can move to another company, restart GC, and recapture this old priority date.

I kept my part time job about 3 yrs while I was working as a full timer at other companies. But the problem is I was getting paid but didn't file H1B as a part timer. I know that I should have filed for H1B but I just had a H1B as a full timer with my other company. If I can count my part time work experience ( 3yrs part time / 2 = 1.5 yrs as full time) along with my full time experience (3.7 yrs), It exceeds 5 yrs of related work experience that requires for EB2.
