I obtained an H1B visa through Company A (starting October 2008) and the H1B visa was valid until September 2011, unfortunately in March 2009 I was laid off. As a result to maintain my status I switched from an H1B visa to a B1/B2 visa. I actually went to my home country and got the visitors visa from the consulate in my home country. In July 2009 I returned to the USA and entered the USA as a visitor on a B1/B2 visa.
My question now is what happens if I obtain employment. What does my new employer have to do? Since my initial H1B approval is valid until September 2011, can by new employer just take over the H1B without me having to go through the lottery system again even though currently I am on a visitors visa and have been unemployed for more than 3 months?

Man I dont know what is the answer to ur question. But I feel very sorry for you and want to appreciate you for keeping your sanity intact till now. I would have joined a lunatic asylum by now if I am in ur position ... I have already started showing some signs just by waiting for my PD to become current.

I'm a mechanical engineering and also have an MBA degree.
I work as a support engineer.
My lawyers tell me that I cannot apply in EB2, since my Post grad degree is unrelated to my grad degree and so does not apply to my job.
Is this true?

Company A - US - Paid in USD on H1B
Company B - India - Paid in Rupees.

that's how infy, wipro, tcs work...they get ppl here on H1 and get paid in dollars....once they go back to india, they get paid in rupees....u need h1 if ur in the US.

I am getting driven nuts as I see the plight of those stuck in name check for years. It is so sad that some of us have had to hold life's decisions waiting for a piece of paper.. thanks anyways.

I want to apply for Green Card in EB2 Category through my employee. But I already have a green card in process via my spouse's employee in EB3 Category.
1. So will I be able to get the priority date of the green card process which is in EB3 Category?
2. Can I add my spouse in my EB2 visa process?

You should just provide a valid reason for your case for the senator to help. All senators have direct lines to immigration offices. They can expedite your case and the results are astonishing.
My cousin left to india for an emergency and his AP was pending. Contacted senator and got it approved immediately in a day.
I also heard that one person got his 140 approved in a week. Not sure what reason he provided.
But senators are certainly helpful unlike Indian politicians.
With reference to some one’s case being transferred to the BEC, there are 300,000 other people in the same boat so hold you’re horses.

Another point to note is that this guy said the N word and all this happened. Lou Dobbs will lose his job the next day if he starts making comments against the African American community. These guys do not even dare go in that territory. We all know what happened to Don Imus. Now If you just replace 'Indians'/immigrants/H1B with the N word, all these anti-immigrant organizations, websites and anti-immigrants will find themselves in a very difficult situation with the law. Civil rights activists will also not let them continue their hatred.
It is high time Indian Americans and immigrants start raising this issue actively and end such racism.

The policies that are supposed to help recovery are being worked on and will take time to show results. Remember nobody felt the recession until 1 year after it actually started. While waiting for the policies to take effect or show results ,positive or negative, they can act on other things that are important.

USCIS Field Offices will be issuing temporary evidence of permanent residence in the form of an I-551 stamp to applicants approved for permanent residence at the time of their interview. You will need to take your passport to your appointment. If you do not have a passport, you must bring a passport style photo and government issued photo identification to receive temporary evidence of permanent residence.
If the application is approved subsequent to your interview or by a Service Center or the National Benefit Center, the applicant should bring the above documents to an INFOPASS appointment to be issued temporary evidence of permanent residence in the form of an I-551 stamp.

Convert to H4 if spouse is on H1B. Chances of getting F2 approval are also high if spouse is on F1 and has not applied for I-140 (even if F2 is approved you should not go out of the country for stamping as the embassy will not issue visa due to intent to immigrate). Greencard processing can continue in the meantime as it is process for future job offering.

I was on H1 status but got laid off. I have my EAD and my AP has been approved but I have not yet received it in the mail. Once I do, is it safe to travel outside the US and re-enter using AP if i don't have job yet?

I got approved H1-B notice on 30th Dec 2008 from CSC. My previous expired H1-B date ends with 02/14/2009, but my current newly approved one starts with 02/26/2009. So there is a gap of 11 days between those. Currently I'm on job. Does it really means out-of-status?. Do I need to run February pay check with less hours and officially in vacation?.
Please advice me.
